Fjord 42 vs Pardo 43: per Hanse Yachts la sentenza è favorevole
Continua la battaglia legale e mediatica fra il gruppo industriale tedesco Hanse Yachts, proprietario del marchio Fiord, e il Cantiere del Pardo, cui fa capo Pardo Yachts, iniziata poche ore prima dell'apertura del Boot di Dusseldorf, lo scorso gennaio.
Oggetto del contendere è il Pardo 43, secondo i tedeschi un'imbarcazione frutto di plagio nei confronti del loro Fjord 42

• Il cantiere navale italiano non è autorizzato a fabbricare, promuovere, vendere o trasferire i loro Pardo 43 con effetto in Italia

Greifswald, 09.03.2018.
HanseYachts può annunciare un altro successo nel caso riguardante il Fjord 42 Open. Il 7 marzo il Tribunale di Genova si è pronunciato contro il CdP e ha confermato l'ingiunzione preliminare contro il cantiere navale accusato di plagio. Di conseguenza, per Cantiere del Pardo è ancora "vietato continuare a fabbricare, pubblicizzare, detenere, esibire, promuovere, vendere o trasferire il Pardo 43, azione limitata ai rapporti economici già esistenti o che verranno istituiti in futuro nel territorio italiano", afferma il Tribunale di Genova. La Corte ha anche stabilito che future violazioni dell'ordine comporteranno sanzioni considerevoli per qualsiasi Pardo 43 che sarà venduto o promesso in vendita o promosso. HanseYachts adotterà tutte le misure legali necessarie per far rispettare tale sentenza.
Nella sua decisione la Corte conferma che il comportamento del cantiere italiano è ingiusto e quindi viola le leggi contro la concorrenza sleale. La Corte ha anche riscontrato forti somiglianze tra il Pardo 43 e il Fjord 42. Il comportamento della parte perdente è stato giudicato ingiusto poiché alcune delle caratteristiche rilevate nello yacht frutto del plagio erano l'ovvia conseguenza di suggerimenti e materiale ricevuti da un concessionario Fjord, che è stato al tempo contattato dal cantiere navale italiano per creare rapidamente uno yacht di successo.
"Questa decisione giudiziaria è una pietra miliare per l'industria nautica. È ora che l'immensa quantità di copie si fermi, non solo nell’ambito delle barche a motore ma anche in quello degli yacht a vela. Il compito futuro del settore sarà quello di evitare copie ingiuste come l'imitazione dell'originale Fjord 42, al fine di mantenere un mercato versatile e qualitativamente elevato per i clienti", afferma il Dr. Jens Gerhardt, CEO di HanseYachts AG.

• This press release is based on the official decision by the Court of Genoa
Greifswald, 09.03.2018. HanseYachts can announce another success in the case concerning the Fjord 42 open. On the 7th of March, the Court of Genoa has ruled against CdP and confirmed the preliminary injunction against the imitating ship yard. As a consequence they are still “forbidden to further manufacture, advertise, hold, exhibit, promote, sell or transfer the Pardo 43, limited to economic relations already existing or that will be instituted in the future in the Italian territory” says the Court of Genoa. The Court also ruled that future breaches of the order will lead to considerable penalties for any Pardo 43 that will be sold or promised for sale or promoted. HanseYachts will take all legal measures necessary in order to enforce this order.
In its decision the Court confirms that the behavior of the Italian shipyard is unfair and thus violates the laws against unfair competition. The Court also saw strong similarities of the Pardo 43 with Fjord 42. The behavior of the losing party was held to be unfair because a number of the features taken over in the imitative yacht were the obvious consequence of suggestions and material received from a Fjord dealer, who was contacted by the Italian ship yard in order to create a successful yacht in a short period of time.
